Bombay HC Disposes Of Plea Challenging ART Age Cap After Medical Tests Find 2 Women Unfit For IVF

Bombay High Court disposed of a plea by two women aged 54 and 56 challenging the upper age limit for assisted reproductive treatment under the Assisted Reproductive Technology Act, 2021.

The women were found medically unfit for IVF after tests at Cama and Albless Hospital; one had hypothyroidism and was post-menopausal for two years, the other had diabetes mellitus and was post-menopausal for five years.

The bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad ruled that the challenge to Section 21(g) of the ART Act became academic due to the medical findings.
