The Allahabad High Court refused to discharge Chandra Prakash Singh alias Goli Thakur, accused of posting casteist remarks against Chandra Shekhar Azad, MP from Nagina.
The court held that at the stage of framing charges, it only examines whether a prima facie case exists, not conduct a mini-trial.
The case was registered under Section 352 of the Bharatiya Nyaya Sanhita (intentional insult), Section 66 of the IT Act, and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
The court noted that while the FIR did not reproduce specific casteist words, it alleged abusive remarks against Azad, and prosecution witness statements specified the words.
