Setback for Trump: US appeals court refuses to revive $100,000 H-1B visa fee

A US federal appeals court refused to lift a ruling blocking a $100,000 H-1B visa fee.

The 1st US Circuit Court of Appeals in Boston left in place a June 8 decision finding the fee unlawful.

The fee was challenged by 20 Democratic attorneys general who argued it created a new tax without congressional approval.

A district judge ruled the fee exceeded executive branch authority.

The appellate panel said the government had not shown it was likely to prevail in its appeal.
