The Court questioned why NHA landowners face a different mechanism than under the Land Acquisition Act, 1894 or the 2013 Act.

The case challenges Sections 3G and 3J of NHA, which provide for compensation determination and arbitration by bureaucrats.

The bench highlighted that compensation is a judicial exercise and should be handled by judicially trained minds.
