SC orders states, UTs to frame policy for early release of terminally ill prisoners

The Supreme Court ordered all states and Union territories to formulate a uniform policy within three months for early release of terminally ill or advanced-age prisoners.

The policy must include a clear definition of terminal illness, objective eligibility criteria, and mandate certification by medical boards.

Policies must be framed and implemented in coordination with respective State Legal Services Authorities (SLSAs).

The Union government was directed to provide technical support and an e-portal for tracking applications.

Compliance affidavits detailing identified, released, and pending prisoners are due within six months, with a monitoring date of January 19, 2027.
