Builder’s heirs liable for delayed possession of flats, NCDRC orders handover with compensation

NCDRC directed heirs of builder Sanjeev Shelke to hand over possession of two flats in Sadashiv Peth redevelopment project 'Shelke Sadan' within six weeks and pay compensation for delay.

Legal heirs Shubhangi Shelke, Sachin Shelke, and Disha Thakur were held liable for contractual obligations despite the developer's death, as they continued the project.

Complainants Anil Shelke, Neeta Shelke, and Shantaram Mazire paid substantial amounts (₹79.52 lakh and ₹66.65 lakh) but possession was denied due to incomplete project and lack of completion/occupancy certificates.

NCDRC bench Justice Sudip Ahluwalia and member Sadhna Shanker rejected limitation and pending civil suit objections, ruling that the builder's obligation to obtain approvals and deliver possession is a continuing one.
