Delhi court upholds 4-year sentence to man in Arms Act case

A Delhi court upheld the four-year rigorous imprisonment of Virender alias Kala Badal under the Arms Act for possessing an illegal country-made pistol and two live cartridges.

Additional Sessions Judge Saurabh Partap Singh rejected the appeal, stating police witnesses are credible unless proven otherwise and no rule requires independent corroboration.

The court found the convict's claim of false implication due to personal enmity and his brother's custodial death unsupported, as it was raised only during the appeal.

The discrepancy in the seal on the seized weapon was dismissed as an inadvertent typographical error that did not break the chain of custody.

The court noted the police had attempted to join independent witnesses but they refused, and absence of videography does not invalidate the recovery.
