US finalizes rule denying Green Cards to benefit recipients

DHS canceled the 2022 public charge rule and issued a new final rule on July 16, 2026.

The new rule allows immigration officers to deny a Green Card if an applicant is likely to become primarily dependent on US government support.

Benefits such as Medicaid, food stamps, and housing assistance may be considered in public charge determinations.

USCIS will publish a revised Form I-485; older editions submitted on or after September 18, 2026 will not be accepted.

The rule takes effect on September 18, 2026, requiring applicants to prove they will not become financial burdens.
