Pune court rejects anticipatory bail plea of advocate accused of assaulting sub-registrar

Additional Sessions Judge A.K. Sharma rejected anticipatory bail for advocate Yogesh Ramdas Kapare on July 30.

Kapare faces charges under the Bharatiya Nyaya Sanhita (BNS), including section 109, which carries a maximum punishment of life imprisonment.

The incident occurred on July 17 at 5:30 pm, when Kapare allegedly assaulted a sub-registrar with kicks, fists, and a bamboo stick after the official refused to execute a sale deed.

The court noted that granting pre-arrest bail would send a 'wrong message' to society and that custodial interrogation was necessary to recover the stick used in the attack.

The court rejected the defence's claim that Kapare deserved protection as an advocate, stating that 'the Constitution of India enshrines equality before the law' and advocates have no special privilege.
