MahaRERA ruled homebuyers can seek refund of clubhouse charges if the amenity remains unbuilt beyond a reasonable period.

MahaRERA ordered a Mumbai developer to refund ₹5 lakh in clubhouse charges collected from a homebuyer who took possession in October 2019.

The clubhouse remained unconstructed more than six years after possession, despite the developer collecting charges as part of the agreement.

The developer argued the clubhouse was a common amenity for a larger integrated scheme, not solely for the buyer's project.

MahaRERA's order reinforces that developers must deliver promised facilities or refund related charges with interest.
