Tariffs on trial: Small businesses take Trump's latest trade levies back to court

Two groups of small businesses filed lawsuits challenging Donald Trump's latest tariffs, which impose double-digit levies on goods from 60 trading partners covering 99% of US imports.

The lawsuits argue the administration failed to justify tariffs under Section 301 of the Trade Act of 1974, which requires showing how measures address specific practices like forced labour.

Learning Resources, a plaintiff in the earlier Supreme Court case, filed one lawsuit in the Court of International Trade; Burlap and Barrel and Collective Horology filed the other, represented by the Liberty Justice Center.

The challengers contend the tariffs effectively replace worldwide duties struck down by the Supreme Court in February, sidestepping the law under a different statute.

Legal experts expect these tariffs to remain in place for an extended period, noting the new lawsuits face a steeper challenge than earlier cases.
