Mumbai MACT Awards ₹9.39 Lakh To 77-Year-Old Worli Resident Hit By Motorcycle While Walking To Public Toilet

Mumbai MACT directed Shriram General Insurance Co. Ltd. to pay ₹9.39 lakh plus 7.5% annual interest to Pandurang Ghadge, a 77-year-old Worli resident.

Ghadge was hit by a motorcycle ridden by Mohd. Sayyed Mohd. Mujjafar Shaikh on April 21, 2023, while walking to a public toilet on Annie Besant Road.

He suffered a right intertrochanteric fracture, underwent ORIF surgery, and was left with 68% permanent partial disability, causing limited mobility and daily life difficulties.

The tribunal assessed his notional monthly income at ₹10,000 as a labourer and awarded ₹2.5 lakh for pain, suffering, and loss of amenities.

The insurer was ordered to pay the full amount first and then recover it from the negligent driver via execution proceedings.
