Karnataka high court restrains govt from taking over HMT’s Jalahalli land
Karnataka high court restrained the state government from taking over more than 430 acres of land at Jalahalli from HMT Limited until the next hearing.
The court passed a restraining order on felling of trees on land other than those sold to third parties.
Justice Suraj Govindaraj issued the interim order while hearing HMT’s petition challenging a June 15 order of the deputy conservator of forests (Bengaluru Urban) directing handover of the land.
HMT claimed the land was gifted by the erstwhile Mysore government before the Karnataka Forest Act came into force.
HMT submitted that the forest department’s proceedings are an abuse of process as denotification of land is pending before the Supreme Court.
