SC flags concerns over functioning of Pharmacy Council, says regulatory uncertainty hurts students

The Supreme Court expressed concerns over the functioning of the Pharmacy Council of India (PCI) and questioned the rationale behind year-to-year approvals for pharmacy colleges.

A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana asked why an 'obsolete' regulatory regime continued despite the Centre's proposed reforms, noting it creates uncertainty for students.

Justice Bagchi questioned the need for annual approvals when institutions have required infrastructure, saying it is unpredictable for students.

Solicitor General Tushar Mehta acknowledged the system creates uncertainty and informed the court that a new legislative framework, similar to the National Medical Commission, is pending; it would establish a National Pharmacy Commission.
