Bombay HC Rejects CIDCOs Plea To Join Navi Mumbai Land Compensation Appeals, Says It Is States Agent

The Bombay High Court rejected CIDCO's plea to join land compensation appeals, ruling it acts only as an agent of the Maharashtra government.
Justice Amit Borkar dismissed CIDCO's interim applications, stating CIDCO is neither a necessary nor proper party under the Land Acquisition Act.
CIDCO argued it should be impleaded as it bears the financial burden of enhanced compensation and relied on 2008 government resolutions.
Landowners cited Section 113(3A) of the MRTP Act to argue CIDCO's role is limited to that of a state agent, a position upheld by prior court rulings.
The court observed that financial burden alone cannot determine legal status and dismissed the applications without costs.
