Bombay HC Directs Reinstatement Of BMC Doctor Suspended In Alleged Fake Birth Certificate Scam

The Bombay High Court ordered reinstatement of BMC medical officer Dr Shailendra Gujar with full back pay, citing procedural violations under the Brihanmumbai Municipal Corporation Services (Discipline and Appeal) Rules, 2015.
Dr Gujar was suspended on May 7, 2026 after his login credentials were allegedly used in a fake birth certificate scam involving unauthorised corrections in December 2024.
A bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankad held that BMC's Rule 4(A) (power to suspend) must be read with Rule 4(B) requiring a preliminary enquiry before suspension.
The court found undue haste and quashed the suspension, but permitted BMC to restart disciplinary proceedings after following prescribed procedure.
