Can’t permit criminal law to influence civil claims: HC
in5points
Karnataka high court quashed criminal proceedings against an elderly Bengaluru woman and her elder daughter in a property dispute.
Justice M Nagaprasanna ruled that criminal law cannot be used as leverage in civil claims.
The case was based on a complaint by the younger daughter Shruthi, a Singapore resident, claiming a one-third share in property sold by her mother Mythili without consent.
The judge noted the dispute is civil in nature and should be resolved through civil courts, not criminal prosecution.
