SC narrows caveat, says states can withdraw FIRs on protesters; CJP reacts
The Supreme Court clarified that states, including NCT of Delhi, are at liberty to withdraw FIRs against student protesters, narrowing 'criminal antecedents' to mean grave and heinous offences only.
The clarification came in response to arguments that the term 'criminal antecedents' was being interpreted broadly, leading to unnecessary arrests.
Chief Justice of India Surya Kant led the bench that issued the clarification on the July 28 order regarding student protests.
Solicitor General Tushar Mehta assured that peaceful protesters who are not hardened criminals would not face legal action.
CJP spokesperson Saurav Das welcomed the clarification, saying the government and BJP/NDA-ruled states must honour the assurances given regarding FIRs.
