A Michigan woman owns 19 acres between two planned Toll Brothers communities

Susan Miller, a Michigan woman, owns 19 acres in Lodi Township between Toll Brothers' planned Arbor Preserve-North and Arbor Preserve-South communities, and has filed a lawsuit in Washtenaw County Trial Court against Toll Brothers Inc., its subsidiary Toll Northeast V Corp, and Red Equities LLC.

The lawsuit claims the developers ignored her property rights and local environmental rules, with plans to build two private wastewater treatment plants that would release treated wastewater 10 feet from her property line, altering water flow into a creek on her land that connects to the Rouse Drain and Saline River.

Miller's only access route from Waters Road is at issue; she signed a conditional agreement with Red Equities in 2021 to end her original private road easement in exchange for a new access road through Arbor Preserve-South, but the agreement's requirements were not met.

Miller seeks to reinstate her access easement and challenge the site plan approvals for the 107-luxury home developments, as stated in court documents.

Her attorney, Sam Estenson, said the developers have 'surrounded and besieged' Miller after she refused to sell her land, and Miller stated that Toll showed little interest in residents' environmental concerns.
