Mohali: Refund ₹44L or hand over flat to buyer, panel directs builder

The district consumer disputes redressal commission in Mohali directed WWICS Estates to either hand over Amit Kashyap's flat or refund ₹44.62 lakh with 15% annual interest.
The builder failed to deliver legal possession of a 3BHK apartment in the WWICS project in Mohali within the agreed 36 months from August 23, 2012, making the committed possession date August 22, 2015.
Amit Kashyap paid ₹44.68 lakh by May 2017, but the builder did not complete the project and demanded additional ₹9.36 lakh without a completion certificate.
The commission rejected the builder's argument of offering possession with a partial completion certificate, noting the final completion certificate was issued only on June 2, 2023.
The panel also awarded ₹50,000 as compensation for mental harassment and litigation expenses.
