Delhi High Court issued notice on Umar Khalid's bail petition in the Delhi riots conspiracy case and sought Delhi Police's response to his interim bail plea.
The court, comprising justices Prathiba M Singh and Vikas Mahajan, directed ASG SV Raju and advocate Dhruv Pande to file replies to Khalid's appeal against the May 4 trial court order rejecting bail.
Khalid sought interim bail citing the Supreme Court's May 22 decision referring to the Chief Justice of India the question of applying the KA Najeeb judgment to UAPA cases involving prolonged incarceration.
On July 4, additional sessions judge Sameer Bajpai rejected fresh bail pleas by Khalid and Sharjeel Imam, citing the pending reference to a larger bench on the divergence between the Gulfisha Fatima and Syed Iftikhar Andrabi rulings.
The matter is listed for hearing on August 27, when the court will also hear co-accused Sharjeel Imam's challenge to the same trial court order.
