The Karnataka High Court ruled that tribunals cannot ignore Income Tax Returns (ITRs) when calculating compensation in motor accident cases. The decision came while enhancing compensation to the family of a deceased woman from Rs 13.3 lakh to Rs 40.54 lakh.
Background
In a 2017 road accident, Shakila B Shetty died after being hit by a BMTC bus. Her family claimed she earned Rs 1 lakh/month running a tutorial and submitted ITRs for 2012-13 to 2016-17. The tribunal awarded only Rs 13.3 lakh, taking notional income of Rs 9,000/month, citing lack of PAN card and signature variations.

The High Court noted that no licence is required to run a tutorial, and ITRs are valid proof of income.
