The National Medical Commission (NMC) has released draft regulations that propose eliminating the requirement for state government essentiality certificates and no-objection certificates (NOC) for establishing new medical colleges. This marks a significant shift in the approval process, centralizing it under the NMC and recognized universities.
Background
Currently, institutions seeking to establish a new medical college must first obtain an essentiality certificate and NOC from the state government before approaching the NMC. The draft amendments to the Establishment of New Medical Institutions Regulations, 2023 propose to delete Clauses 9(a) and 9(c) that mandate these state approvals.
Key facts
Under the draft, new medical colleges will only need a valid Consent of Affiliation (CoA) from a recognized university and approval from the NMC.
The draft deletes Clauses 9(a) and 9(c) of the 2023 regulations, which required state essentiality certificate and NOC.
Clause 9(b) is revised to make a valid CoA from a recognized university mandatory.
Infrastructure norms are tightened: all infrastructure and statutory requirements must be completed before application; temporary arrangements or under-construction buildings are not allowed.
A dedicated corpus fund will be required for all new medical colleges; existing institutions must also maintain one. The amount is determined by the Medical Assessment and Rating Board (MARB).
Stricter action against incomplete applications or attempts to influence NMC/MARB: such applications may be rejected outright.
NMC has invited public comments before finalizing the regulations.
