The Central Consumer Protection Authority (CCPA) has taken suo motu action against 41 restaurants across India for automatically adding service charge to bills without consumer consent. This follows complaints via the National Consumer Helpline and a recent Delhi High Court judgment upholding CCPA guidelines against mandatory service charge.

Background

CCPA issued guidelines on 4 July 2022 to prevent unfair trade practices related to service charge in hotels and restaurants. The Delhi High Court on 28 March 2025 upheld the validity of these guidelines in the case of National Restaurant Association of India vs Union of India, ruling that mandatory service charge is illegal.
