CCPA fines SpiceJet ₹1 lakh for dark patterns on flight booking platform
UPSC / SSC current affairs note · Polity
Why in news
The Central Consumer Protection Authority (CCPA) imposed a ₹1 lakh penalty on SpiceJet for using deceptive design practices (dark patterns) on its flight booking platform. This action highlights the enforcement of consumer protection laws against manipulative online interfaces.
Background
Dark patterns are design tricks that manipulate users into taking actions they did not intend, such as unwanted subscriptions or sharing personal information. The CCPA had issued guidelines on prevention and regulation of dark patterns in 2023, and the Consumer Protection (E-commerce) Rules, 2020 require explicit consumer consent.
Key facts
CCPA imposed ₹1,00,000 penalty on SpiceJet for dark patterns on its flight booking platform.
SpiceJet automatically enrolled users into SpiceClub loyalty program via pre-ticked checkboxes without their active consent.
Default options were pre-selected for receiving promotional messages, assuming consent without user action.
After CCPA notice, SpiceJet changed the method but continued using pre-ticked checkboxes for future messages via SMS, WhatsApp, and email.
CCPA identified three dark patterns: Forced Action (auto-enrollment), Interface Interference (default options favoring the company), and Trick Question (confusing consent language).
These practices violated Consumer Protection Act, 2019, Rule 4(9) of Consumer Protection (E-commerce) Rules, 2020, and Guidelines for Prevention and Regulation of Dark Patterns, 2023.
SpiceJet claimed the issue was a technical glitch; CCPA directed it to take corrective steps and provide an undertaking for permanent discontinuation.
CCPA emphasized that consumer consent must be clear, informed, and freely given; pre-ticked checkboxes or default settings do not constitute valid consent.
