The Karnataka High Court has directed the state government to examine extending institutional support to senior citizens, similar to the Juvenile Justice Act, 2015. This comes in a case where an ailing 74-year-old woman was allegedly abandoned by her son. The court has sought a report by August 11 on proposed measures.
Background
The Maintenance and Welfare of Parents and Senior Citizens Act, 2007, is the existing legal framework for senior citizen care. The court is assessing whether this Act adequately addresses situations of neglect, abuse, and abandonment.
Key facts
Karnataka HC directed Mysuru deputy commissioner and assistant commissioner to admit an ailing senior citizen to a government hospital and provide medical care at state expense.
The 74-year-old woman suffers from gangrene in her right foot and was allegedly abandoned by her son.
The court asked the state to examine extending institutional support to senior citizens on the lines of the Juvenile Justice (Care and Protection of Children) Act, 2015.
A report on proposed measures is due by August 11.
In February 2024, the court had stayed a tribunal order cancelling a gift deed, subject to the son paying Rs 10,000 monthly maintenance.
The court enlarged the scope to assess if the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, needs additional executive, policy, or legislative measures.
Justice Suraj Govindaraj observed that a framework is needed for senior citizens requiring state intervention due to age, infirmity, abandonment, neglect, abuse, or vulnerability.
Common complaints include neglect, abandonment, abuse, exploitation, deprivation of maintenance, denial of residence, unlawful property deprivation, lack of medical care, and absence of institutional support.
