Why in news
The government has notified the Solid Waste Management (SWM) Rules, 2026, replacing the 2016 rules, effective from 01.04.2026. These rules mandate sanitary landfill management and legacy waste treatment in Delhi-NCR. The Minister of State for Environment, Forest and Climate Change provided details in a Rajya Sabha reply.
Background
The Solid Waste Management Rules, 2016 were the previous framework. Legacy waste dumpsites in Delhi-NCR have been a major source of air pollution, leading to CAQM directions. The new rules aim to address these issues with stricter provisions.

Sanitary landfill defined as final disposal of residual solid waste and inert waste with measures to protect groundwater, surface water, dust, odor, fire, animals, GHG emissions, POPs, slope stability, and soil erosion.
Local bodies to establish, construct, operate and maintain sanitary landfills through eligible agencies.
District Magistrate to ensure sanitary landfill operation complies with rules.
Audit of clean landfill operations for non-recyclable, non-energy-recoverable dry waste and inert waste to be done by SPCB/PCC/registered environmental auditor as per CPCB guidelines.
SPCB/PCC to upload audit reports on centralized portal.
CPCB issued direction under Section 5 of Environment (Protection) Act, 1986 on 27.01.2021 for biomining and bio-remediation of legacy waste dumpsites.
CAQM issued direction No. 91 on 03.06.2025 for management of legacy waste at landfill sites in NCR to control PM10, PM2.5, NO2, SO2, CO, dioxins, furans.
7 legacy waste dumpsites identified in Delhi-NCR: 3 in Delhi, 1 each in Gurugram, Noida, Greater Noida, Ghaziabad.
Treatment of 4 dumpsites in NCR completed so far.
